update on the 90's accident

contacted the idiots insurance co. they said the guy already contacted them and they would have to have an investigation to see who was at fault. i politely told them it was the idiot that they were insuring fault. they took a statement from me besides asking some pretty stupid questions, like why was i only doing 25 in a 45 mph zone. i told them that i am not on the track and don't burn rubber everytime i start up from a red light and especially in the rain. the adjustors tune changed when i told her they were very lucky i wasn't hurt and that i have a police report that has the statements of the two eyewitnesses on it. this was on tues 3/31. in wednesdays mail i get an envelope from the municipal court and i figure the guy is trying to beat the ticket and i have to testify. instead the idiot went down and swore out 3 tickets against me. he is trying to put the blame on me. have to go to court and talk  to the prosecutor and explain the situation and asked that the tickets be dismissed. if they refuse, which after viewing the accident report with the officer citing him a ticket, i would be shocked if they don't dismiss them, then i will have to get a lawyer.AngryWits EndCensored

Dave, just when you think it couldn't get any worse.........it does. I couldn't believe that the "idiot" could get three tickets issued to you..........man this is getting crazy. Unfortunately you'll have to fight this........but YOU WILL WIN.......the best of luck to you, and keep us posted.

The best thing is that you have the truth on your side.
When this is all done and you have collected from his insurance co., you should bust his chops and sue him for malicious prosecution for the ridiculous tickets he had sworn out against you.

Good thing you had those people that saw the whole thing, well we already knew this guy was an A hole, so not to surprised. I think that knee cap bit is a good idea.

i agree 100% alan about having the two witnesses and they stayed around and told the cops. too many people don't want to get involved these days.Thumbs Up kevin, as you say, i have the truth on my side and i don't want to stoop to his level. he is probably jealous that he doesn't have a corvette but people like him don't deserve to have one.Clap hmmm... ikind of like paul's idea too but then i definately would wind up in jailRolling On The Floor Laughing. anyway his punishment will come after his insurance co. pays the bill. hope like heck they either triple his insurance or drop him all together and make him

sorry about not updating sooner but have had a bunch of things to get done. went to court on 4/14 and talked to prosecutor about dismissing the charges and told her that he is trying to blame me and explained what happened. she said in cases like this 95% of the time people try this. she said she could not drop the tickets as he will be acting as the prosecutor as it is a civil complaint.

courts today are like the show lets make a deal. as the judge is taking care of the guilty pleas, people are still making deals with the prosecutor. anyway i am sitting waiting and after about 2 hours judge calls my name and i go up front. he asks if the other driver is there and i tell him i didn't know and the guy steps up. the judge then says that under the plea agreement the guy made with the prosecutor all charges against me will be dismissed and his ticket will be reduced to careless driving instead of improper passing.

now i am waiting for his insurance co to pay me. they appear to be jerking me around. my sister works for a lawyer and they made a call and she said they were idiots. they are sending me the paperwork to file a suit if need be. will be calling his insurance co tomorrow one last time before filing the papers.

i am pissed as the weather has been great here (except for last week) for rides with the top off. hopefully this will light a fire under their butts to send me the check.Thumbs Up

Are you sure you aren't hurt???  BTW, make d a m n sure he doesn't put a mechanic's lean on your house.  In Oklahoma, it can be done for the price of a $50 filing fee without cause or justification.

I like the countersuit idea.  It would serve the SOB right and if your sister could get someone to take the case for contingency, then who cares if you get a share...

Dennis is right, I think your shoulder and arm has been bothering you since the accident, I mean you were hanging on so hard for dear life. Id send that letter and ask what specialist they recomend to look at your injury. you poor dear man, look at how you favor that sore armBig smile

Now now I would normally state that this is the reason why insurance rates are outragious.....But in this instance it should be looked at on a case by case basis, and this case I thought you said your back hurt right! better get that looked at whiplash is dangerous.Wink
