WASHINGTON (AP) -- A federal appeals court overturned the District of Columbia's long- standing handgun ban Friday, rejecting the city's argument that the Second Amendment right to bear arms applied only to militias.
In a 2-1 decision, the judges held that the activities protected by the Second Amendment "are not limited to militia service, nor is an individual's enjoyment of the right contingent upon his or her continued intermittent enrollment in the militia."
A lower-court judge in 2004 had told six residents they did not have a constitutional right to own handguns. The plaintiffs include residents of high-crime neighborhoods who wanted the guns for protection.
The Bush administration has endorsed individual gun-ownership rights, but the Supreme Court has never settled the issue.
If the dispute makes it to the high court, it would be the first case in nearly 70 years to address the Second Amendment's scope.

Indeed,
"the right of the people, to keep and bear arms, shall not be infringed"
funny how the anti's leave that statement out.....
In light of recent elections and the shocking possibility that the dems might make it back in since the Repub's can't get their collective $h!t together, I went out and purchased an AR-15 S&W 5.56. I still have all the pre-ban long clips for the one I recently sold.
Don't wanna be caught with my pants down.
Don't wanna be caught with my pants down.
AS HAS BEEN SAID MANY TIME BEFORE, GUNS DON'T KILL.............PEOPLE DO.
ENFORCE THE LAWS ALREADY ON THE BOOKS.
DON'T MAKE NEW ONES THAT HELP THE CRIMINALS AND TIE THE HANDS OF THE CITIZENS.

Tell the U.S. House to Vote “No” on H.R. 1022, a New Bill to Ban “Assault Weapons” Your help is needed to stop a new assault on the 2nd Amendment of the U.S. Constitution. On Feb. 13, 2007, Representative Carolyn McCarthy (D-N.Y.) introduced H.R. 1022 <http://thomas.loc.gov/home/gpoxmlc110/h1022_ih.xml> , a bill with the stated purpose, “to reauthorize the assault weapons ban, and for other purposes.” This bill would not only reauthorize the Clinton “assault weapons” ban of 1994, but would ban many more guns this time around, and furthermore, make the ban permanent. Congress allowed the 1994 ban to expire in 2004 for multiple reasons, including the fact that federal, state and local law enforcement agency studies showed that guns affected by the ban had been used in only a tiny percentage of crimes, before and after the ban was imposed. McCarthy’s “other purposes” would make matters even worse. H.R. 1022 would ban every gun banned by the 1994 Clinton “assault weapons” ban, plus millions more guns, including:

McCarthy’s “other purposes” would make matters even worse. H.R. 1022 would ban every gun banned by the 1994 Clinton “assault weapons” ban, plus millions more guns, including:
- Every gun made to comply with the Clinton ban. (The Clinton ban dictated the kinds of grips, stocks and attachments new guns could have. Since then, manufacturers modified many guns to satisfy the Clinton requirements. H.R. 1022 would ban the modified guns too.)
- Guns exempted by the Clinton ban. (Ruger Mini-14s and -30s and Ranch Rifles; .30 cal. carbines;and fixed-magazine, semi-automatic, center-fire rifles that hold more than 10 rounds.)
- All semi-automatic shotguns. (e.g., Remington, Winchester, Beretta and Benelli, used forhunting, sport shooting, and self-defense. H.R. 1022 would ban them because they have “any characteristic that can function as a grip,” and would also ban their maincomponent, called the “receiver.”)
- All detachable-magazine semi-automatic rifles – including, for example, the ubiquitousRuger 10/22 .22 rimfire – because they have “any characteristic that can function as a grip.”
- Target shooting rifles. (e.g., the three centerfire rifles most popular for marksmanshipcompetitions: the Colt AR-15, the Springfield M1A and the M1 “Garand.”)
- Any semi-automatic shotgun or rifle an Attorney General one day claims isn’t“sporting,” even though the constitutions of the U.S. and 44 states, and the laws of all 50 states, recognize the right to use guns for defense.
- 65 named guns (the Clinton law banned 19 by name); semi-auto fixed-magazine pistols of over 10rounds capacity; and frames, receivers and parts used to repair or refurbish guns.
- The importation of magazines exempted by the Clinton ban, ban the sale of a legally-owned“assault weapon” with a magazine of over 10 rounds capacity, and begin backdoor registration of guns, by requiring private sales of banned guns, frames, receivers andparts to be conducted through licensed dealers.
