Any Lawyers Out There?

Here is the situation: I went to a car show on Sat. Another car club promoting their show put a flier in my car on the passenger seat. The seat was wet from the rain we had and the flier paper (orange colored) bled onto my leather seat. I called the car club that put the flier in my car and they say they are not responsible, I should be watching my car. I didn't ask them to put their flier in my car so I think they should be responsible for the damage. Any thoughts or legal advise would be great. I want to take them to small claims court, I have never sued anyone before and don't even know where to start. Thanks

I think you'll have a hard time proving who actually put the flier in the car...someone else could have moved it out of their car and put it in yours...ya never know.

Of course, I ain't no lawyer, so...

That really sux, man. That's why I hate people doing that. Sometimes, I'll find 15-20 fliers in the car after walking around looking at the other cars. Then again, we pass C3VR fliers out too....
Have you tried any leather cleaner on it yet? I know there are a couple of pro detail folks that are members here, so maybe one of them will see this and offer some help with cleaning the seat(s).

Call your insurance guy and see what he says. maybe they will go after them or the car show may be responsible. I hope you get it sorted out!

Dave M. is suggesting the correct approach. Your beef is not with the car club unless they specifically authorized someone to place fliers on vehicles.

Most likely it was a good club member who thought they were helping out the club by placing the fliers on the cars. I doubt that any thought of the ink bleeding off of the paper and staining any objects never occurred. (Remember these are car folks).

The sponsoring car club is right as well that part of the responsibility lies with the owner to secure the vehicle. That is why you notice signs placed on some vehicles stating "Do Not Touch!" I have also seen waivers that were to be signed admonishing the event sponsor from liability in case of theft or accident.

Todd, tux has a good point. I guess any one of us would not have thought anything wrong with handing out flier's for our clubs.

I'm sure you were or still are fuming, we all work hard on these toys. So I guess the question is how to get rid of that stain. We see so many adds on tv that pretty much remove anything. When I purchased my last couch I asked what is the best material to hold up to kids? Salesman said leather, you can clean anything off of it. I would see what cleaning products are out there for leather. I'm sure some cute little kid has taken a sharpie to a leather chair or couch somewhere. I'll spend some time on google for ya to see what's out there.

I feel for 'ya and realize how you must feel, but how was someone to know "The seat was wet from the rain " when they tossed those flyers in your car?
 
My advice, chaulk it up to life's little experiences and move on to the next cruise night - the summer is too short anyway. Confused

Well I guess the consensus opinion is to let it go. I guess if the seat was used more than 10 times since I spent the winter re-doing the interior I might not be so upset. I will have to bring a porta-pot with me and not look at other cars from now on at the rest of the shows I go to just like the president of the car club who distributed the fliers said" I don't ever leave my car" I also thought he could have been more like a car guy and tried to help with the situation instead of just flat out telling me it was my problem. Thanks for letting me vent, I will get over it.

Heh, its ok. "Water under the bridge" "spilt milk" the older I get and something like this happens, I think don't stress out and stroke over it. Don't sweat the small stuff, some one could have keyed the car.
One thing we all will thank you for....I'll make sure I watch out for flyiers in my front seat. Did you try any of those cleaning tips?

Vette(s): had a really nice one. sold it to a good friend. Purchased 2004 custom coupe in Feb. 2009 did not tell anyone here until August 2009. BAD I KNOW.
Todd sorry to hear man, that is rough after all the hard work, and yes that other club and enough the sponsor club should at least be car guys and split the cost 3 ways that way every one is equally at fault and taking their share of the loss and using this as a learning experience, I know I will, from now on at shows if I leave my ride the windows are up and top rag top laid over the corkpit, even think I am going to laminate a flyer myself for each seat and windshield stated that "due to Color bleeds of some papers and inks please do not attempt to place any solicitations  in this vechile hand all flyers to the the owner"
